Website Operator and Scope
This website is operated by Timberbrook Insurance Agency LLC, referred to as Timberbrook Insurance, we, us, or our. These terms govern access to this website, its general content, and its online inquiry and service request tools. By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, discontinue use.
You must be at least 18 to submit an application or service request through this website, unless a different process is specifically authorized by us and permitted by law. If you act for another person or business, you must have authority to do so.
These terms do not replace an insurance policy, binder, endorsement, signed agency agreement, separately accepted service agreement, or legally required notice. Applicable law and the insurance contract control insurance coverage. A separate agreement controls a matter it specifically addresses if it conflicts with these website terms.
Insurance Information and Availability
Website descriptions, examples, articles, calculators, and other materials provide general information. They may summarize coverage without describing every exclusion, limitation, eligibility rule, or condition. They are not legal, tax, accounting, or investment advice.
Actual coverage depends on the issued policy, endorsements, applicable law, and the facts of a particular claim. Availability, premiums, deductibles, limits, and underwriting requirements may change and vary by insurer, location, and circumstances. We do not guarantee eligibility, acceptance, a particular premium, the lowest available price, or that an insurer will pay a particular claim.
Insurance services are offered only where the agency and participating professionals are properly licensed or otherwise authorized and the product is lawfully available. Access to the website does not establish that we can offer insurance in every state.
Quotes, Applications and Binding Coverage
Submitting a form, requesting a quote, uploading a document, requesting a certificate, making a payment, or sending an email, voicemail, or text message does not by itself bind, renew, reinstate, change, or cancel insurance. An automated acknowledgment confirms receipt only.
A quote is an estimate or proposal, subject to the insurer's underwriting, verification, approval, and applicable terms. An indication, illustration, or proposal is not a binder or policy. A requested effective date does not establish that coverage begins on that date.
Do not assume coverage or a requested change is effective until you receive a binder, policy, endorsement, or other written confirmation from the insurer or an agency representative acting within their authority that identifies the coverage and effective date or time. Payment alone does not establish that an insurer has accepted the risk or that coverage has been reinstated.
Nothing in these terms invalidates coverage lawfully bound or issued by an authorized insurer or representative, or eliminates duties arising from an actual agreement to procure or service insurance.
Service Requests, Cancellations and Communications
Online forms, email, voicemail, and texts are not monitored continuously. Delivery can be delayed, filtered, interrupted, or unsuccessful. A submission confirmation or read receipt does not establish that a request has been reviewed or completed.
For an urgent request, contact the agency directly or use an insurer's authorized service channel. Confirm that the appropriate party has received and acted on the request. Do not rely on a pending website submission to meet an insurance deadline.
Requests to cancel or reduce coverage may require signatures, supporting documents, insurer approval, or compliance with policy terms. Cancellation dates, refunds, minimum earned premiums, and other charges are determined by the insurance contract and applicable law. Do not assume an existing policy has been canceled, or cancel it in anticipation of replacement coverage, until the relevant actions are confirmed.
An optional reminder or courtesy notice does not replace an insurer's notice or extend a payment, renewal, reporting, or other deadline. These terms do not eliminate any reminder or notice obligation we have specifically undertaken or that law requires.
Claims and Emergencies
For immediate danger or an emergency, call 911 or the appropriate emergency service. This website and our texting program are not emergency services.
Report a claim promptly through the reporting method required by your policy or the insurer's authorized claims channel. A website form, certificate request, or message to the agency may not satisfy the policy's notice requirements. If you ask us to assist, confirm the claim has been reported to the appropriate insurer.
We may help communicate with an insurer, but the insurer evaluates coverage and administers claims under its policy and applicable law. Our assistance does not guarantee coverage, acceptance, payment, or an outcome. This provision does not reduce duties we otherwise owe in handling a request for claims assistance.
Certificates, Evidence of Insurance and Contracts
A certificate request does not create or change insurance. A certificate of insurance summarizes coverage in effect or bound when properly issued; it is not an insurance policy and does not amend, extend, or alter the policy's coverage or terms.
Naming a certificate holder does not by itself make that person an additional insured, provide a waiver of subrogation, or create a right to cancellation or nonrenewal notices. Any such status or right must exist under the policy, an applicable endorsement, or law. We cannot certify coverage or rights that the policy does not provide.
Unless we separately agree to a specific review, requesting a certificate or sending us a contract does not engage us to determine whether your insurance satisfies every contractual requirement or to provide legal advice about that contract. Review contractual insurance requirements with appropriate legal counsel and discuss any needed coverage or endorsements with us before work begins. Our agreed services and legal duties remain in effect.
Your Information and Coverage Review
Provide complete and accurate information, and promptly tell us about material corrections or changes relevant to your insurance. Do not submit false or misleading information, impersonate another person, or provide information you are not authorized to disclose. Missing or inaccurate information may affect underwriting, premiums, eligibility, or coverage, subject to policy terms and law.
Review applications before signing and review binders, declarations, policies, endorsements, and notices when received. Notify us promptly of errors, omissions, or differences from the coverage you requested. Raise questions about limits, deductibles, exclusions, valuation, insured parties, and activities that need coverage. Your review does not waive a right or excuse our professional obligations.
Website tools and general guidance cannot identify every exposure or replace an individualized coverage review. Providing this website alone does not create an agreement to audit your business, verify legal or contractual compliance, or continuously monitor changes in your exposures. The scope of any actual engagement and applicable law determine our professional responsibilities.
Independent Agency and Compensation
We are an insurance agency, not an insurance company. We may seek coverage through insurers or insurance intermediaries with which we have access or relationships; we do not represent every insurer or offer every product in the market.
The insurer is responsible for its policy obligations. We do not guarantee an insurer's future financial condition or performance. This statement does not excuse our own legal or professional duties.
We may receive commissions and other compensation from insurers or insurance intermediaries as permitted by law. Any agency fee we charge is subject to applicable law and separate disclosure or agreement where required. These website terms do not authorize a fee or payment charge.
Privacy, Sensitive Information and Electronic Delivery
Our Privacy Policy describes our information practices. Do not send Social Security numbers, driver's license numbers, payment card numbers, bank account information, medical records, or other sensitive information through general forms, ordinary email, or text. Contact us to arrange an appropriate secure method.
We may respond to an inquiry using the contact information and lawful communication method you provide. Providing a number or accepting these terms does not by itself authorize recurring SMS, marketing texts, or prerecorded marketing calls. The Text Messaging Terms below apply when you separately consent to that program.
Choosing email or texting for routine communications does not automatically authorize electronic delivery of legally required policy documents, cancellation notices, or other records. Any required electronic delivery consent and disclosures are handled separately under applicable law.
Text Messaging Terms
Program and Purpose
Timberbrook Insurance provides an optional customer care SMS/MMS program for insurance inquiries and agency services. With your express consent, messages may include follow ups on quotes you request, requests for information, appointment coordination, policy service updates, certificate request updates, and renewal reminders. Messages may be sent by staff or through automated tools. This program does not send marketing or promotional texts.
Consent
You may enroll through a documented written opt in process that we provide to you, such as a signed or electronic consent form. Providing a phone number, selecting a preferred contact method, buying a policy, or accepting these website terms does not by itself enroll you. If you initiate a text conversation, we may reply to that inquiry; we obtain additional written consent before enrolling you in recurring notifications. You must be the subscriber or authorized user of the number you provide. Consent is not a condition of purchasing insurance or receiving services.
Frequency and Charges
Message frequency varies according to your inquiries, policies, and service activity. Message and data rates may apply under your mobile plan. Timberbrook Insurance does not charge a separate subscription fee for the texting program.
Opt Out
Reply STOP to any program message to unsubscribe. We also honor other clear requests to stop messages, including requests sent to service@timberbrookins.com or made by calling 210.801.6466. You may receive one nonpromotional message confirming your opt out. We then stop program messages unless you provide new consent. Opting out does not cancel or change an insurance policy; we may communicate necessary service information through other lawful channels.
Help
Reply HELP for assistance, call 210.801.6466, or email service@timberbrookins.com. Texting is not an emergency, claim reporting, or coverage binding service. Use the insurer's authorized claims channel or contact the agency directly for time sensitive insurance matters.
Delivery and Number Changes
Messages may be delayed or undelivered because of carrier, network, device, or other conditions. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed. Tell us promptly if your number changes, is reassigned, or is no longer under your control; do not rely on a text reminder to meet an insurance deadline.
Privacy and Program Changes
Mobile opt in information and SMS consent are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. We do not share your mobile number with those parties for their own marketing or promotional purposes. Providers may process opt in information and consent on our behalf solely to operate the program, maintain consent records, and honor opt outs, or as required by law. See our Privacy Policy. We may modify or discontinue the program subject to applicable law. Expanding the program to marketing or another purpose requiring consent requires a separate consent process.
Acceptable Use
Use the website only for lawful purposes. You may not introduce malicious code; interfere with website security or availability; attempt unauthorized access; send spam; submit fraudulent requests; harvest personal information; or scrape, reproduce, or use website content in a way that violates law or our rights. Ordinary search engine indexing is permitted if it respects applicable access restrictions.
We may restrict access or reject submissions that violate these terms, threaten security, or misuse the site, subject to applicable law. Restricting website access does not terminate an insurance policy.
Ownership and Third Party Services
The Timberbrook Insurance name, agency branding, and content we create are owned by us or used with permission. Insurer names, logos, and other third party materials belong to their respective owners. You may view the site for personal or internal business use and share links. Other copying, republication, commercial reuse, or alteration requires permission from the applicable owner, except as permitted by law.
Links, embedded tools, insurer portals, payment services, and other independent services may be governed by separate terms and privacy notices. A link does not guarantee the service's accuracy, security, availability, or suitability. We are not responsible for an independent third party's content or conduct except to the extent applicable law imposes responsibility on us.
Website Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS GENERAL CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT WITH RESPECT TO THE WEBSITE. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR FREE CONTENT, OR THAT THE WEBSITE WILL BE FREE OF HARMFUL COMPONENTS.
We may correct errors, change content, or suspend website features. These website disclaimers do not alter an insurance contract or any professional duty we owe.
Website Liability Limits
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM USE OF THE WEBSITE OR ITS GENERAL CONTENT.
These limits apply only to website use. They do not limit rights under an insurance policy; liability arising from insurance placement, advice, or servicing; our privacy or data security obligations; our gross negligence, fraud, or willful misconduct; or any liability or consumer right that cannot lawfully be limited. These terms do not waive rights under the Texas Deceptive Trade Practices Act or the Texas Insurance Code.
Governing Law, Disputes and Enforceability
Texas law governs these terms, except where applicable federal law or another mandatory law controls. To the extent permitted by law, disputes arising solely from these website terms or website use will be brought in state courts in Bexar County, Texas, or in a federal court with jurisdiction over Bexar County. This provision does not determine jurisdiction or venue for an insurance policy dispute or restrict a nonwaivable legal right.
You may contact us to try to resolve a concern. Doing so is not a condition of filing a regulatory complaint or exercising a legal right. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of later enforcement.
Changes
We may update these terms and identify the revised date above. Revised terms apply prospectively, subject to any notice or assent required by law; they do not retroactively waive accrued rights or expand SMS consent. We provide additional notice or request consent when required.
